Karnataka court fines Zomato ₹60,000 for a missing ₹133 momo order

Eshappa K Bhute, president of the commission, in Karnataka court fines Zomato and ordered the company to pay Sheethal ₹50,000 for the inconvenience and mental agony caused to her, along with ₹10,000 for her litigation cost.

A consumer court in Karnataka ordered Zomato to pay a woman ₹60,000 for failing to deliver her momos order in 2023. The District Consumer Disputes Redressal Commission in Dharwad issued the ruling on July 3.

Sheethal placed a ₹133.25 order for momos via G-Pay on August 31, 2023. She received a message that her order would arrive in 15 minutes. However, she claimed she never received the order or saw the delivery agent.

When Sheethal checked with the restaurant, they confirmed the delivery agent had picked up the order. She tried to contact the agent, but he did not respond. She then complained to Zomato via email and was told to wait 72 hours.

After no response, Sheethal sent a legal notice to Zomato on September 13, 2023. Zomato’s counsel appeared in court and denied the allegations.

The court noted that Zomato did not respond to Sheethal’s complaint until after she filed her case. She eventually received a ₹133.25 refund on May 2, 2024, from Zomato.

“Zomato is conducting business by supplying materials for online orders. Despite receiving payment, Zomato did not deliver the product to the complainant. Based on these facts, we find Op no. 1 (Zomato) solely liable for the complainant’s claim,” the commission said, as reported by Indian Express.

Eshappa K Bhute, president of the commission, ordered Zomato to pay Sheethal ₹50,000 for the inconvenience and mental agony caused, and ₹10,000 to cover her litigation costs.
